The New German Law On Telecommunications. Basic Principles And Provisions

From 1998 the existing German monopoly in network telecommunication is to be opened up to competition. Legislation to this end is currently proceeding through the legislature. This article considers the main features of the legislation, identifying controversial aspects which may be the subject of amendments by the Bundesrat and assesses the likely impact of the legislation upon the burgeoning telecommunications market. Consideration is given both to the regulatory framework proposed including the introduction of systems of licensing of service provides and to the substantive aspects of the new legislation.
