Is the 'shrinkwrap' licence worth the paper envelope it's printed on?

Although shrink-wrap licensing has been used in the mass distribution of software for more than a decade. Nevertheless, its enforceability has always been suspect, at best.

This article traces the relatively sparse case law on the subject and recent legislative initiatives, which give cause for optimism and caution in future enforcement actions.
